Clients expect a professional (lawyer, accountant, doctor) to know how to keep them from being harmed financially, medically or emotionally. If the professional fails to do this, they may be accused of malpractice and breaching their duty to serve in their client's best interests.

An attorney can be accused of legal malpractice if he/she not only uses a legal strategy that is questionable, but also makes critical mistakes that a reasonable attorney would not make. If this did happen, an expert witness would most likely be brought in to prove that the lawyer had breached his/her duty to serve their client's best interests and was thus negligent.

The same holds true when a client counts on a professional to meet a certain level of care. If the professional fails to do this by committing an error or an "egregious breach of conduct" this can be considered professional negligence.

If a healthcare or building professional acts unethically and violates a common practice, then they too may have engaged in malpractice.

Or if a financial advisor offers poor investing advice while not meeting a standard level of service by those in the industry, then the client may be able to seek damages.
